Letter to Homeowners- Feb 15,2011

Dear Settlers Village Homeowners,                                         February 15, 2011

We are beginning 2011 with many desires and goals, among them the continuation of the excellent living conditions in our community.  All of us are certainly contributors to this end.  Many simple actions, mostly common sense actions can provide significant improvements to our efforts.  In general, adherence to our stated covenants will accomplish much to provide for exceptional living here.  Always realize the covenants alone don't insure our great living conditions but are guidelines to promote it.  Specifically, several improvement opportunities have come to the attention of the Property Manager/Board.

The Property Manager and Board have observed/been notified of multiple instances of residents/tenants feeding wild animals, not cleaning up after domestic animals, and parking in driveways, which if not remedied, will lead to significant problems throughout the community.

The Rules, Regulations, and Architectural Guidelines address these situations as follows:

5.  NUISANCES

For the purposes of these rules and regulations, a nuisance is broadly defined as any activity or use of a homeowner's property or the common areas that is:

                        Unreasonable, unwarranted or unlawful or;

                        That results in or may result in physical damage or injury or;

                        Is an annoyance, inconvenience or discomfort to another resident, or;

                        Interferes with another resident's lawful use or enjoyment of their property.

Since these terms cannot be fully defined and a nuisance is subjective in nature,

enforcement … outlined in the bylaws of the Association (Article X, Sections 1-6 inclusive).

No homeowner shall engage in or allow any activity that may be considered a nuisance.

6.  PARKING

All access roads to garages are considered private driveways and are fire access lanes.  No parking is allowed in the driveways, and vehicles in violation are subject to immediate towing without notice, in addition to applicable fines.

Vehicles in driveways are considered standing vehicles so long as they are attended for purposes of loading, unloading, washing, or similar purposes.  Standing vehicles are not in violation of these rules as long as they are attended and do not interfere with resident or emergency vehicle access. 

7.  PETS

A resident may keep no more than two household pets (dogs and/or cats) with the requirement that:

            They are not kept, bred, or maintained for any commercial purposes.

            They do not make objectionable noises.

When outside, they are on a leash being held by a person capable of controlling the animal.

The homeowner has the absolute duty to immediately clean up after such animals.

(Note that certain of these rules are also Highlands Ranch covenants and Douglas County ordinances.)

We have quite a visceral reaction to sending you a letter quoting "Rules and Regulations" and hesitate in so doing, yet simple adherence to the covenants will greatly enhance the experience of all residents.
